The terms governing accounts and services on the MTCode Platform.

These Terms of Service ("Terms") are between you and BrightTime Technologies, Inc. ("BrightTime Tech", "we", "us"). They govern your access to and use of the MTCode Platform at MTCodeAI.com, including accounts, registered servers, published services, and related features (collectively, the "Platform"). By creating an account or using the Platform, you agree to these Terms.
The Platform offers administrator accounts (which register and manage servers) and user accounts (which access services made available by an administrator). You agree to provide accurate registration information, to keep your credentials secure, and to be responsible for all activity under your account. You must notify us promptly of any unauthorized use of your account.
Each administrator account includes a free plan. The features and usage limits of the free plan β including the number of users that may access servers registered under an account β are described on the Pricing page and may be updated from time to time. Paid subscription plans may be offered in the future to allow additional users or provide enhanced features; their details will be published on the Pricing page, and notice of any newly introduced fees will be given through the Platform or MTCodeAI.com. Your continued use of the Platform following the introduction of paid plans constitutes acceptance of those terms as they apply to your selected plan.
The Platform and its client software currently do not display advertisements. If we decide to introduce advertisements or sponsored content for free-plan users in the future, we will provide at least thirty (30) days advance notice before any advertisements are displayed. Notice will be delivered by a notice posted on MTCodeAI.com and by email sent to the user accounts. Paid-plan users will not be shown advertisements. Your continued use following the notice period constitutes acceptance of advertisements under the free plan.
You agree not to use the Platform to:
Servers and services registered on the Platform are operated by the administrators who publish them, not by BrightTime Tech. Administrators are solely responsible for the services they publish, including their content, availability, security, and legality, and for their compliance with these Terms. Your use of any published service is at your own risk, and BrightTime Tech does not endorse, guarantee, or assume responsibility for any published service.
Installed client applications (such as MTCode Portal, MTCode Server, and related tools) are licensed under their own End User License Agreements, included with each application. Those agreements govern the installed software; these Terms govern your Platform account and services.
The Platform processes account information and operational data (such as authentication events, registered server metadata, and connection records) as necessary to operate the service. Client software may transmit operational data to MTCodeAI.com for account authentication, license validation, and server management. We do not use this data for tracking or profiling beyond what is necessary for the operation of the Platform.
The Platform, including its software, design, and content provided by BrightTime Tech, is the exclusive property of BrightTime Technologies, Inc. "MTCode", "MTCode Portal", "MTCodeAI", and related logos are trademarks of BrightTime Technologies, Inc. These Terms do not grant you any right to use such trademarks.
You may stop using the Platform and delete your account at any time. We may suspend or terminate your account if you violate these Terms, if required by law, or if we discontinue the Platform. Where practical, we will provide notice before termination. Sections 5, 8, 10, 11, and 12 survive termination.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NONINFRINGEMENT. BRIGHTTIME TECH DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOU ASSUME ALL RISK ASSOCIATED WITH YOUR USE OF THE PLATFORM.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BRIGHTTIME TECHNOLOGIES, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM, ANY UNAUTHORIZED ACCESS TO YOUR DATA, ANY THIRD-PARTY CONDUCT OR CONTENT (INCLUDING SERVICES PUBLISHED BY ADMINISTRATORS), OR ANY OTHER MATTER RELATING TO THE PLATFORM, UNDER ANY LEGAL THEORY. IN NO EVENT SHALL BRIGHTTIME TECH'S TOTAL AGGREGATE LIABILITY EXCEED THE TOTAL AMOUNT, IF ANY, ACTUALLY PAID BY YOU TO BRIGHTTIME TECH FOR THE PLATFORM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless BrightTime Technologies, Inc. and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, any service you publish as an administrator, your violation of these Terms, or your violation of any applicable law or the rights of any third party.
We may modify these Terms at any time. Material changes will be announced through the Platform or MTCodeAI.com. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of laws principles.
